Agreement to these terms
By using sablecreative.co, you agree to these terms. If you don't agree, please don't use the site.
You must be at least 13 to use this site, or the minimum age of digital consent in your jurisdiction if it's higher. If you're using the site on behalf of a company, you confirm you have the authority to accept these terms for that company.
These terms vs. project agreements
These terms govern your use of sablecreative.co. That's their job.
If you engage Sable Creative on a paid project, that engagement is governed by a separate project agreement we send when the project is confirmed. (You may see it called a Statement of Work or Master Services Agreement.) Scope, pricing, payment, revisions, deliverables, ownership of the work, and warranties on what we deliver are covered in that agreement, not here.
If these website terms and a signed project agreement conflict, the project agreement controls for that engagement.
Use of the site
You're welcome to view, read, and share this site. Link to it, quote it with attribution, send pages to clients or colleagues. That's the intended use.
You agree not to:
- Scrape, harvest, mass-download, or use the site's content to train AI or machine learning systems without our written permission.
- Copy or republish the site's content wholesale, or reverse engineer anything we haven't published as open source.
- Attempt to disrupt, overload, or gain unauthorized access to the site or its infrastructure.
- Use the site for any illegal purpose, or to impersonate Sable Creative or anyone else.
Intellectual property
The content on sablecreative.co, including the copy, design, code, photography, illustrations, trademarks, and the Sable Creative name and logo, is owned by Sable Creative or its licensors. All rights are reserved except as expressly granted here.
We grant you a limited, personal, non-commercial license to view and share the site with attribution. Nothing on the site grants you the right to copy, reproduce, modify, or use its content commercially without our written permission. If you'd like to use something, email hello@sablecreative.co and ask.
Third-party links and services
The site links to third-party websites, including client work, tools we use, and companies we reference. We don't control those sites, we don't endorse their content, and we're not responsible for what you find on them.
Follow those links at your own discretion, and read each site's own terms and privacy policy before using it.
Forms and communications
When you submit the form at /start, you're starting a conversation about a potential project. A form submission is not a contract, an offer, or a commitment on either side. We may reply, we may decline, or we may not respond.
A project only begins once we've agreed on scope and you've signed a project agreement. Until then, nothing you send through the form obligates either of us.
Disclaimer of warranties
The site is provided "as is" and "as available." We make no warranties, express or implied, about the site itself, its content, or its availability. We don't guarantee the site will be uninterrupted, error-free, secure, or always accurate. We don't guarantee that links will work or that third-party services will stay online.
This disclaimer covers the website only. Warranties on work we deliver under a project agreement are addressed in that agreement.
Limitation of liability
To the fullest extent allowed by law, Sable Creative is not liable for indirect, incidental, consequential, special, or punitive damages arising from your use of the site. That includes lost profits, lost data, and business interruption, even if we've been told such damages were possible.
Our total liability for any site-related claim is capped at $100, or what you've paid Sable Creative for website access in the past 12 months, whichever is greater. The site is free, so in practice this cap is $100.
This limitation covers the website only. Liability on paid project work is addressed in the project agreement.
Indemnification
You agree to indemnify and hold Sable Creative harmless from any claim, loss, or expense (including reasonable legal fees) caused by your misuse of the site. This covers violations of these terms, violations of any law, and infringement of any third-party right in connection with the site.
Termination
We may suspend or end your access to the site at any time, at our discretion, especially if you've violated the acceptable use rules in Use of the site.
Some sections are built to survive termination. Intellectual property, disclaimers, limitation of liability, indemnification, and governing law remain in effect after access ends.
Governing law and venue
These terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Any dispute arising from these terms or your use of the site will be heard in the state or federal courts of Lubbock County, Texas. That includes the United States District Court for the Northern District of Texas.
You and Sable Creative consent to the jurisdiction of those courts.
Changes to these terms
We may update these terms from time to time. When we do, we'll change the "Last updated" date at the top of this page. For material changes, we'll make a reasonable effort to give notice on the site itself.
Your continued use of the site after we post updated terms means you accept the new terms. If you don't agree with the update, please stop using the site.
